McCoy Russell won another complete reversal by the Patent Trial and Appeals Board (PTAB) in the area of real-time control systems. Our team, led by John Russell, challenged the applicability of Ex parte Wu that the claimed invention was obviousness for eliminating a step from the prior art without any new function. After the oral hearing, the PTAB concluded that the rejections were erroneous and therefore reversed. See appeal 2017-009884.
